After several years of extensive, hard fought litigation, final global settlements have been reached resolving three class action lawsuits against Macy's West.
The first settlement resolves certain claims raised in two lawsuits brought by individuals with mobility disabilities:
Macy's West, Inc. is the legal name for all the Macy's stores in California, and the Settlement Agreement applies only to Macy's West stores in California. The claims resolved in this settlement concern the levels of access provided by Macy's West to the merchandise offered for sale on self-service display units in its California stores.
Claims by people with mobility disabilities against the Macy's West Union Square store in San Francisco are not covered by the above settlement, but have been resolved in a separate settlement in the companion case Lieber v. Macy's West, Inc., Case No. C96-02955. Three years after the trial concerning access at the San Francisco Union Square Macy's, Lieber v. Macy's continues to set the standard for retail access throughout the nation. Judge Marilyn Patel's Order found that Macy's had violated the ADA and California state law by failing to provide access to merchandise for people with mobility disabilities.
Settlement has been reached on the spacing in the pads at Union Square, based on an injunction issued by the court, that requires substantially all of the merchandise to be located on accessible routes.
